Terms of Service

These terms govern your use of the Pubd website (pubd.io), the Pubd dashboard, and the websites and services we provide. By using them you agree to these terms. Specific commercial terms for a build (price, scope, timelines) are set out in your separate client agreement, which prevails if it conflicts with these terms.
The service
Pubd designs, builds and hosts custom websites and provides a content management dashboard so clients can edit their own content. Optional features — such as the analytics & SEO dashboard, newsletter tools and online booking or shop modules — may be available depending on your plan.
Your account
You’re responsible for keeping your login secure and for activity under your account. Tell us promptly if you suspect unauthorised use.
Acceptable use
You agree not to use the service to publish unlawful, infringing or harmful content, to attempt to disrupt or gain unauthorised access to our systems, or to misuse any connected third-party account. You’re responsible for the content you publish through the CMS.
Content and ownership
You own the content you provide and publish, and (per your client agreement) your domain name. Pubd retains ownership of the underlying CMS platform and software. You grant us the permissions needed to host and display your content as part of the service.
Third-party connections
If you connect a Google account for analytics and SEO features, your use of that data is also subject to Google’s terms, and our handling of it is described in our Privacy Policy.
Fees
Fees, billing frequency and what’s included are set out in your client agreement. Where fees are overdue, we may suspend the service after reasonable notice.
Availability and disclaimer
We make reasonable efforts to keep sites online and the service running, but we don’t guarantee uninterrupted or error-free operation. The service is provided “as is” to the extent permitted by law. Nothing in these terms limits rights you have under the New Zealand Consumer Guarantees Act or other non-excludable law.
Limitation of liability
To the extent permitted by law, Pubd is not liable for indirect or consequential loss, and our total liability arising from the service is limited to the fees you paid us in the prior 12 months.
Termination
Either party may end the arrangement in line with the client agreement. On termination we’ll help you transition your content and domain. You can stop using the service at any time.
Changes
We may update these terms from time to time. We’ll update the “last updated” date above when we do.
Governing law
These terms are governed by the laws of New Zealand.
